Motion to Dismiss
Prosecution, Alleged Victim Agree to Drop Charge Against Kobe Bryant

By Ellen Davis and Bill Redeker


E A G L E, Colo., Sept. 1, 2004 — Prosecutors will file a motion this afternoon to dismiss the sexual assault charge against Kobe Bryant, according to sources familiar with the case.

The motion will say that both the alleged victim and Bryant agree to the request. Prosecutors will ask that it be dismissed with prejudice, meaning that the charge can never be brought again.

That girl is so stupid, if Kobe ends up raping someone else that girl is going to have to feel partially responsible.

ok, its a little harsh to be accusing kobe of rape. if he really did it, i dont think this would have happened. then again, i dont know all the details, and i dont care to know them. i got sick of hearing about this along time ago. they cant report the girl's name, but the media is allowed to judge kobe?

i think that if the girl refuses to go under oath and tell everyone about her life and what really happened, it kind of hints she might of just made up the rape part. from a basketball stand point im happy hes back, and from a human stand point im glad he can relax without this added pressure and sit back with his gorgeous wife

I'm willing to bet he did nothing illegal. That being said, this whole ordeal was poetic justice for him cheating on his wife.

We'll see.
If he's really innocent,nothing of this nature will surface again.If more allegations follow,there may be a pattern of behavior [like this girls' sexual history].Look at Michael Jackson.He was accused once and still continued to have sleepovers with young boys.
Whatever your point of view may be,you can't win if you don't have the money to defend yourself.These celebrities get away with a lot of stuff!

I think its a bit presumptious to say he raped her. There was a lot of evidence that contradicted her story(right after the 'rape' a fellow employee saw her and she was smiling, joking around and laughing), and she did lie on the stand in one of the hearings.

didnt you hear about all the death threats she got? I think she'd be dead by now if they released and kept it released (they kept on releasing it for like 3 hours every 3 months... it was weird).

I disagree. Blame the law and the legal system that puts your entire life on trial due to the acts of one man. She was on trial here, not Kobe.

I didn't think she actually took the stand, did she?

We will never know whether or not she was raped or not. The truth is, the court in Eagle County DID leak a lot of evidence and information to the public/press, which is uncalled for.

Now we can wait for Kobe to actually buy her out, so the Civil Trial never comes to fruition.

I think it is just as easy to assume she WAS raped as to assume she WASNT by these proceedings. It could easily have turned out that she was sick of the whole thing... being drug around by the press... etc etc and offered to drop the case as long as Kobe wrote out an apology and gave her lots of mula. If Kobe never did rape her then his written "apology" sure was surprising. I'm not sure I would so quickly apologize for something I never did. Kobe would have been better off seeing this case through to the end and fully clearing his name instead of leaving it open like this... unless of course he was afraid of going to jail...
