NPR has learned that Supreme Court Justice David Souter is planning to retire at the end of the court's current term.

The court has completed hearing oral arguments for the year and will be issuing rulings and opinions until the end of June.

Souter is expected to remain on the bench until a successor has been chosen and confirmed, which may or may not be accomplished before the court reconvenes in October.

My best guess at a replacement:
Ruben Castillo
Jennifer Granholm
Sonia Sotomayor

souter had a real head scratcher of a decision in the past month.. i wish i could remember exactly what it was (i am getting so senile, I may be ready for a seat on the SCOTUS myself....lol).. but it was appalling coming from a liberal and had to do with privacy/personal liberty rights.. when i think of it, i will re post.. but i remember being stunned that it was souter..

Corley v. United States?

i apologize because i dont remember the name of the case.. i just remember it had to do with individual rights and/or privacy and i would have completely expected souter to come down on the side of the individual.. but he didnt and wrote a majority opinion that would have pleased W..

dang it !! i will think about it....

God i love my wife....she reminded me.. it was about the poor 12 year old girl who had her panties searched by school officials on suspicion of having ibuprofen in
her undies..souter decided that the well being of the school trumped the poor girls right not to have her underware taken off of her because of a rumor started by one of her friends.. disgusting !!!

and NOT by police, but by a counselor !!

I don't think that case has been adjudicated yet.

The case is Safford Unified School District v. Redding

Souter asked during oral arguments, "If the school official’s thought process, was ‘I’d rather have a kid embarrassed rather than some other kid dead,’ isn’t that reasonable under the Fourth Amendment?”

And for what it is worth, I throw in the name Ann Claire Williams for Souter's replacement.

I just hope the replacement puts the rights of terrorists ahead of keeping America safe. I for one am sick and tired of the government being able to properly protect us.

if he goes with Sotomayor, there are 9 current GOP senators that voted to confirm her nomination to the court of appeals. seems like she'd be easy to go through.

in a note that's sure to piss off Dustin and IBB if she's the pick, Rick Santorum voted for her :)

So she's not a baby killer?

not a clue what her views on the law are yet, but Papa Bush appointed her in the first place.

So she's not a baby killer?

Randall Terry thinks she's evil, so she has to support Roe v Wade. And there's no way Obama appoints a judge who's against it.
